RE: The tariff classification of aluminum calcium alloy from China

Dear Mr. Sinclair:

In your letter dated September 12, 2013 you requested a tariff classification ruling.

The product intended for import is described as aluminum calcium alloy in irregular lump form. The alloy is stated to be 60-85 percent aluminum and 15-40 percent calcium. All other elements are stated to be less than 0.5 percent each. The alloy lumps do not contain any lead and are not scrap remelt ingots.

The applicable subheading for the aluminum calcium alloy lumps will be 7601.20.9090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for unwrought aluminum: aluminum alloys: other, other, other, other, other. The rate of duty will be free of duty.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
